Draft Flood Risk Management Plans Consultation

SEPA and the 14 Lead Local Authorities (The Highland Council, Comhairle nan Eilean Siar, Orkney Islands Council, Shetland Islands Council, Moray Council, Aberdeenshire Council, Angus Council, Perth and Kinross Council, Stirling Council, The City of Edinburgh Council, Scottish Borders Council, Dumfries and Galloway Council, Glasgow City Council and North Ayrshire Council) identified under sections (30) and (35) of the Flood Risk Management (Scotland) Act 2009 have joint data controller responsibility under the Data Protection Act 1998 for accessing, managing and sharing personal data submitted by respondents in the course of this consultation.

SEPA and the 14 Lead Local Authorities can extend joint data controller responsibilities in order to share your consultation responses with other Responsible Authorities as defined under section (5) of the Flood Risk Management (Scotland) Act 2009 and the Flood Risk Management (Designated Responsible Authorities) (Scotland) Order 2013.

These other Responsible Authorities are: Aberdeen City Council, Argyll and Bute Council, Clackmannanshire Council, Dundee City Council, East Ayrshire Council, East Dunbartonshire Council, East Lothian Council, East Renfrewshire Council, Falkirk Council, Fife Council, Inverclyde Council, Midlothian Council, North Lanarkshire Council, Renfrewshire Council, South Ayrshire, South Lanarkshire Council, West Dunbartonshire Council, West Lothian Council, Scottish Water, Loch Lomond and Trossachs National Park Authority, Cairngorms National Park Authority and Forestry Commission Scotland. Any extension to these other Responsible Authorities will be under the same terms and conditions as SEPA and the 14 Lead Local Authorities are subject to.

Draft Strategic Environmental Assessment Consultation

SEPA has a duty to carry out a strategic environmental assessment of the Flood Risk Management Strategies, as required by the Environmental Assessment (Scotland) Act 2005 and is therefore identified as having sole data controller responsibility under the Data Protection Act 1998 for accessing and managing personal data submitted by respondents in the course of this consultation. SEPA alone will have access to personal data submitted under the Strategic Environmental Assessment consultation and stored on the Citizen Space consultation platform.
